Terms of Service

1. What ShortPlay is

ShortPlay is a discovery feed for indie web games. Some games are link cards that direct you to a third-party host (e.g., itch.io) where the game is played; others are hosted games we serve directly. By using ShortPlay you agree to these Terms. If you don’t agree, don’t use the service.

2. Not affiliated with third-party hosts

ShortPlay is not affiliated with, endorsed by, or sponsored by itch.io or any other game host or creator unless explicitly stated. Names and marks (e.g., “itch.io”) are used only to identify where a game lives. When you tap a link card, you leave ShortPlay and are subject to the destination’s own terms and privacy practices, which we do not control and are not responsible for.

3. Acceptable use

You agree not to: (a) use the service unlawfully or to infringe others’ rights; (b) attempt to breach, probe, or circumvent security, sandboxing, or rate limits; (c) scrape, harvest, or bulk-extract content except as expressly permitted; (d) misrepresent your affiliation with any person or creator; or (e) interfere with other users’ use of the service.

4. Content & intellectual property

Games, cover art, descriptions, and marks belong to their respective creators and hosts. ShortPlay’s own software, design, and compilations are owned by us or our licensors. We respond to claims of infringement under our Copyright / DMCA Policy — if you believe content on ShortPlay infringes your rights, use the in-app report flow or contact us at [email protected].

DMCA designated agent. Our agent for notices of claimed copyright infringement, registered with the U.S. Copyright Office, is: DMCA Agent, From The Reeds LLC, 7901 4th St N, Ste 300, St. Petersburg, FL 33702; phone (727) 625-7945; email [email protected]. To submit a notice, include the information required by 17 U.S.C. § 512(c)(3). We will respond to properly submitted notices and, in appropriate circumstances, remove or disable access to the material.

5. Reports & moderation

You can report a game (e.g., broken, mature content, or infringing) via the in-app report control. We review reports and may remove or disable content at our discretion. We are not obligated to host or keep any particular content.

Objectionable content & conduct. There is zero tolerance for objectionable content or abusive behavior — including harassment, hate, threats, content that sexualizes minors, or spam. You are responsible for what you post. You can report any comment or game, and block any user; we review reports and act on genuine violations. Accounts that post objectionable content or abuse others are subject to the restrictions and enforcement in §5 (including the read-only restricted state), up to removal.

ShortPlay aims to be safe for general audiences — we do not allow adult or explicit content. Being broadly safe does not make ShortPlay a children’s service: it remains a general-audience, 13+ service, not designed for children (see §8).

Repeat infringers & enforcement. In appropriate circumstances we will restrict or terminate the accounts of users who repeatedly infringe others’ intellectual property, and of users who repeatedly or seriously violate these Terms or our Content Policy. A restricted account is limited to read-only access — you can still browse and play, but cannot post comments, upload, or publish. If you believe a restriction was applied in error, you may appeal by emailing [email protected].

6. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that games (especially third-party games reached via link cards) are accurate, safe, available, or fit for any purpose.

7. Limitation of liability

To the fullest extent permitted by law, ShortPlay and From The Reeds LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the service. Because ShortPlay is free to use, our aggregate liability for any claim will not exceed USD $100.

8. Age & children

ShortPlay is a general-audience service and is not directed to children under 13. You must be at least 13 to use ShortPlay. If you are between 13 and the age of digital consent in your country (up to 16 in parts of the EU/UK), you may use ShortPlay only with the consent of a parent or guardian. We do not knowingly collect personal information from anyone under 13; if we learn we have, we delete it (contact [email protected]). ShortPlay is not designed for children, and we do not direct behavioral or targeted advertising to users we know or reasonably believe are minors. See our Privacy Policy.

9. Changes; termination

We may update these Terms; material changes will be posted with a revised effective date. We may suspend or terminate access for violations of these Terms.

10. Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute arising from these Terms or your use of ShortPlay will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
